THEEUROPEANPARLIAMENTANDTHECOUNCILOFTHEEUROPEANUNION,

HavingregardtotheTreatyestablishingtheEuropeanCommunity,andinparticularArticle100athereof,

HavingregardtotheproposalfromtheCommission(1),

HavingregardtotheopinionoftheEconomicandSocialCommittee(2),

ActinginaccordancewiththeprocedurelaiddowninArticle189boftheTreaty(3),

HavingregardtotheCouncilDirective89/107/EECof21December1988ontheapproximationofthelawsoftheMemberStatesconcerningfoodadditivesauthorizedforuseinfoodstuffsintendedforhumanconsumption(4),andinparticularArticle3(2)thereof,

Whereasdifferencesbetweennationallawsrelatingtopreservatives,antioxidantsandotheradditivesandtheirconditionsofusehinderthefreemovementoffoodstuffs;whereasthismaycreateconditionsofunfaircompetition;

Whereastheprimeconsiderationforanyrulesonthesefoodadditivesandtheirconditionsofuseshouldbetheneedtoprotecttheconsumer;Whereasitisgenerallyrecognizedthatunprocessedfoodstuffsandcertainotherfoodstuffsshouldbefreefromfoodadditives;

Whereas,havingregardtothemostrecentscientificandtoxicologicalinformationonthesesubstances,someofthemaretobepermittedonlyforcertainfoodstuffsandundercertainconditionsofuse;

Whereasitisnecessarytolaydownstrictrulesfortheuseoffoodadditivesininfantformulae,follow-onformulaeandweaningfoods,asreferredtoinCouncilDirective89/398/EECof3May1989ontheapproximationofthelawsoftheMemberStatesrelatingtofoodstuffsintendedforparticularnutritionaluses(5),andinparticularArticle4(1)(e)thereof;

WhereasthisDirectiveisnotintendedtoaffectrulesrelatingtosweet-enersandcolours;

Whereas,pendingspecificprovisionspursuanttoCouncilDirective91/414/EECof15July1991concerningtheplacingofplantprotectionproductsonthemarket(6),andpursuanttoCouncilDirective90/642/EECof27November1990onthefixingofmaximumlevelsforpesti-cideresiduesinandoncertainproductsofplantorigin,includingfruitandvegetables(7),certainsubstancesbelongingtothiscategoryareprovisionallycoveredbythisDirective;

WhereastheCommissionistoadaptCommunityprovisionstoaccordwiththeruleslaiddowninthisDirective;

▼WhereastheScientificCommitteeforFoodhasbeenconsultedforthosesubstanceswhicharenotyetthesubjectofaCommunityprovi-sion;

WhereasitisnecessarytoincludeinthisDirectivespecificprovisionsconcerningadditivesreferredtoinotherCommunityprovisions;Whereasitisdesirablethatwhenadecisionistakenonwhetheraparticularfoodstuffbelongstoacertaincategoryoffoods,theconsulta-tionoftheStandingCommitteeforFoodstuffsprocedureisfollowed;WhereasmodificationsofexistingpuritycriteriaforfoodadditivesotherthancoloursandsweetenersandnewspecificationsforthosewherenopuritycriteriaexistwillbeadoptedinaccordancewiththeprocedurelaiddowninArticle11ofDirective89/107/EEC;

WhereastheScientificCommitteeforFoodhasnotyetgivenanopiniononflourtreatmentagents;whereasthoseagentswillbethesubjectofaseparateDirective;

WhereasthisDirectivereplacesDirectives64/54/EEC(1),70/357/EEC(2),74/329/EEC(3)and83/463/EEC(4);whereasthoseDirectivesareherebyrepealed,

HAVEADOPTEDTHISDIRECTIVE:

Article1

▼1.ThisDirectiveisaspecificDirectiveformingapartofthecomprehensiveDirective,withinthemeaningofArticle3ofDirective89/107/EEC,andappliestoadditivesotherthancoloursandsweet-eners.ItdoesnotapplytoenzymesotherthanthosementionedintheAnnexes,

2.OnlyadditiveswhichsatisfytherequirementslaiddownbytheScientificCommitteeforFoodmaybeusedinfoodstuffs.3.

ForthepurposeofthisDirective:

(a)‘preservatives’aresubstanceswhichprolongtheshelf-lifeoffood-stuffsbyprotectingthemagainstdeteriorationcausedbymicro-organisms;(b)‘antioxidants’aresubstanceswhichprolongtheshelf-lifeoffood-stuffsbyprotectingthemagainstdeteriorationcausedbyoxidation,suchasfatrancidityandcolourchanges;(c)‘carriers’,includingcarriersolvents,aresubstancesusedto

dissolve,dilute,disperseorotherwisephysicallymodifyafoodadditivewithoutalteringitstechnologicalfunction(andwithoutexertinganytechnologicaleffectthemselves)inordertofacilitateitshandling,applicationoruse;(d)‘acids’aresubstanceswhichincreasetheacidityofafoodstuff

and/orimpartasourtastetoit;(e)‘acidityregulators’aresubstanceswhichalterorcontrolthe

acidityoralkalinityofafoodstuff;(f)‘anti-cakingagents’aresubstanceswhichreducethetendencyofindividualparticlesofafoodstufftoadheretooneanother;(g)‘anti-foamingagents’aresubstanceswhichpreventorreduce

foaming;(h)‘bulkingagents’aresubstanceswhichcontributetothevolumeof

afoodstuffwithoutcontributingsignificantlytoitsavailableenergyvalue;

▼(i)‘emulsifiers’aresubstanceswhichmakeitpossibletoformormaintainahomogenousmixtureoftwoormoreimmisciblephasessuchasoilandwaterinafoodstuff;(j)‘emulsifyingsalts’aresubstanceswhichconvertproteinscontainedincheeseintoadispersedformandtherebybringabouthomogenousdistributionoffatandothercomponents;(k)‘firmingagents’aresubstanceswhichmakeorkeeptissuesoffruit

orvegetablesfirmorcrisp,orinteractwithgellingagentstoproduceorstrengthenagel;(l)‘flavourenhancers’aresubstanceswhichenhancetheexistingtasteand/orodourofafoodstuff;(m)‘foamingagents’aresubstanceswhichmakeitpossibletoforma

homogenousdispersionofagaseousphaseinaliquidorsolidfoodstuff;(n)‘gellingagents’aresubstanceswhichgiveafoodstufftexture

throughformationofagel;(o)‘glazingagents’(includinglubricants)aresubstanceswhich,when

appliedtotheexternalsurfaceofafoodstuff,impartashinyappearanceorprovideaprotectivecoating;(p)‘humectants’aresubstanceswhichpreventfoodstuffsfromdrying

outbycounteractingtheeffectofanatmospherehavingalowdegreeofhumidity,orpromotethedissolutionofapowderinanaqueousmedium;(q)‘modifiedstarches’aresubstancesobtainedbyoneormore

chemicaltreatmentsofediblestarches,whichmayhaveundergoneaphysicalorenzymatictreatment,andmaybeacidoralkalithinnedorbleached;(r)‘packaginggases’aregasesotherthanair,introducedintoacontainerbefore,duringoraftertheplacingofafoodstuffinthatcontainer;(s)‘propellants’aregasesotherthanairwhichexpelafoodstufffromacontainer;(t)‘raisingagents’aresubstancesorcombinationsofsubstanceswhichliberategasandtherebyincreasethevolumeofadoughorabatter;(u)‘sequestrants’aresubstanceswhichformchemicalcomplexeswith

metallicions;

▼(v)‘stabilisers’aresubstanceswhichmakeitpossibletomaintainthe

physico-chemicalstateofafoodstuff;stabilisersincludesubstanceswhichenablethemaintenanceofahomogenousdisper-sionoftwoormoreimmisciblesubstancesinafoodstuff,substanceswhichstabilise,retainorintensifyanexistingcolourofafoodstuffandsubstanceswhichincreasethebindingcapacityofthefood,includingtheformationofcross-linksbetweenproteinsenablingthebindingoffoodpiecesintore-constitutedfood;(w)‘thickeners’aresubstanceswhichincreasetheviscosityofafood-stuff.4.Flourtreatmentagentsotherthanemulsifiersaresubstanceswhichareaddedtoflourordoughtoimproveitsbakingquality.5.ForthepurposesofthisDirectivethefollowingarenotconsid-eredasfoodadditives:

(a)substancesusedfortreatmentofdrinkingwaterasprovidedforin

Article2

▼1.OnlysubstanceslistedinAnnexesI,III,IVandVmaybeusedinfoodstuffsforthepurposesmentionedinArticle1(3)andArticle1(4),2.FoodadditiveslistedinAnnexIarepermittedinfoodstuffs,forthepurposesmentionedinArticle1(3)andArticle1(4),withtheexceptionofthosefoodstuffslistedinAnnexII,followingthe‘quantumsatis’principle,

▼3.Exceptwherespecificallyprovidedfor,paragraph2doesnotapplyto:(a)—

▼unprocessedfoodstuffs,

honeyasdefinedinDirective74/409/EEC(1)

non-emulsifiedoilsandfatsofanimalorvegetableorigin,butter,

—pasteurisedandsterilised(includingUHT)milk(includingplain,skimmedandsemi-skimmed)andplainpasteurisedcream,—unflavoured,livefermentedmilkproducts,

—naturalmineralwaterasdefinedinDirective80/777/EEC(2)andspringwater,

—coffee(excludingflavouredinstantcoffee)andcoffeeextracts,—unflavouredleaftea,

—sugarsasdefinedinDirective73/437/EEC(3),

—drypasta,excludinggluten-freeand/orpastaintendedforhypo-proteicdiets,inaccordancewithDirective89/398/EEC,—naturalunflavouredbuttermilk(excludingsterilizedbuttermilk).WithinthemeaningofthisDirective,theterm‘unprocessed’meansnothavingundergoneanytreatmentresultinginasubstantialchangeintheoriginalstateofthefoodstuffs;however,thefood-stuffsmayhavebeen,forexample,divided,parted,severed,boned,minced,skinned,pared,peeled,ground,cut,cleaned,trimmed,deep-frozenorfrozen,chilled,milledorhusked,packedorunpacked;

▼(b)foodsforinfantsandyoungchildrenasreferredtoinDirective89/

398/EEC,includingfoodsforinfantsandyoungchildrennotingoodhealth;thesefoodstuffsaresubjecttotheprovisionsofAnnexVI;(c)thefoodstuffslistedinAnnexII,whichmaycontainonlythose

additivesreferredtointhatAnnexandthoseadditivesreferredtoinAnnexesIIIandIVundertheconditionsspecifiedtherein.4.AdditiveslistedinAnnexesIIIandIVmayonlybeusedinthefoodstuffsreferredtointhoseAnnexesandundertheconditionsspeci-fiedtherein.

5.OnlythoseadditiveslistedinAnnexVmaybeusedascarriersorcarriersolventsforfoodadditivesandmustbeusedunderthecondi-tionsspecifiedtherein.

6.TheprovisionsofthisDirectiveshallalsoapplytothecorre-spondingfoodstuffsintendedforparticularnutritionalusesinaccordancewithDirective89/398/EEC.

7.MaximumlevelsindicatedintheAnnexesrefertofoodstuffsasmarketed,unlessotherwisestated.

8.IntheAnnexestothisDirective,‘quantumsatis’meansthatnomaximumlevelisspecified.However,additivesshallbeusedinaccor-dancewithgoodmanufacturingpractice,atalevelnothigherthanisnecessarytoachievetheintendedpurposeandprovidedthattheydonotmisleadtheconsumer.

Article3

▼1.

Thepresenceofafoodadditiveispermissible:

(a)inacompoundfoodstuffotherthanonementionedinArticle2(3),

totheextenttowhichthefoodadditiveispermittedinoneoftheingredientsofthecompoundfoodstuff;(b)inafoodstuffwhereaflavouringhasbeenadded,totheextentto

whichthefoodadditiveispermittedintheflavouringincompli-ancewiththisDirectiveandhasbeencarriedovertothefoodstuffviatheflavouring,providedthefoodadditivehasnotechnologicalfunctioninthefinalfoodstuff;or(c)ifthefoodstuffisdestinedtobeusedsolelyinthepreparationofa

compoundfoodstuffandtoanextentsuchthatthecompoundfood-stuffconformstotheprovisionsofthisDirective.

▼2.Paragraph1doesnotapplytoinfantformulae,follow-onformulaeandweaningfoods,asreferredtoinDirective89/398/EEC,exceptwherespeciallyprovidedfor.

▼3.Thelevelofadditivesinflavouringsshallbelimitedtotheminimumnecessarytoguaranteethesafetyandqualityofflavouringsandtofacilitatetheirstorage.Furthermore,thepresenceofadditivesinflavouringsmustnotmisleadconsumersorpresentahazardtotheirhealth.Ifthepresenceofanadditiveinafoodstuff,asaconsequenceofaddingflavourings,hasatechnologicalfunctioninthefoodstuff,itshallbeconsideredasanadditiveofthefoodstuffandnotasanaddi-tiveoftheflavouring.

ThisDirectiveshallapplywithoutprejudicetospecificDirectivespermittingadditiveslistedintheAnnexestobeusedassweetenersorcolours.

▼Article5

Wherenecessary,itmaybedecidedbytheprocedurelaiddowninArticle6ofthisDirective:

—whetheraparticularfoodstuffnotcategorizedatthemomentthisDirectivewasadoptedbelongstoacategoryoffoodstuffsreferredtoinArticle2orinoneoftheAnnexes,or

—whetherafoodadditivelistedintheAnnexesandauthorizedat‘quantumsatis’isusedinaccordancewiththecriteriareferredtoinArticle2,or

—whetherasubstanceisafoodadditivewithinthemeaningofArticle1.

▼Article6

1.TheCommissionshallbeassistedbytheStandingCommitteeontheFoodChainandAnimalHealth,setupbyArticle58ofRegulation(EC)No178/2002(1),hereinafterreferredtoas‘theCommittee’.2.WherereferenceismadetothisArticle,Articles5and7ofDeci-sion1999/468/EC(2)shallapply,havingregardtotheprovisionsofArticle8thereof.

TheperiodlaiddowninArticle5(6)ofDecision1999/468/ECshallbesetatthreemonths.3.

▼Article7

MemberStatesshall,withinthreeyearsoftheentryintoforceofthisDirective,establishsystemstomonitortheconsumptionanduseoffoodadditivesandreporttheirfindingstotheCommission.

TheCommissionshallreporttotheEuropeanParliamentandtheCouncilwithinfiveyearsoftheentryintoforceofthisDirectiveonthechangeswhichhavetakenplaceinthefoodadditivesmarket,thelevelsofuseandconsumption.

Inaccordancewiththegeneralcriteriainpoint4ofAnnexIItoDirec-tive89/107/EEC,withinfiveyearsoftheentryintoforceofthisDirective,theCommissionshallreviewtheconditionsofusereferredtointhisDirective,andproposeamendmentswherenecessary.

Article8

1.Directives64/54/EEC,70/357/EEC,74/329/EECand83/463/EECareherebyrepealed.

2.ReferencestotheserepealedDirectivesandtothepuritycriteriaforcertainfoodadditivesreferredtointhemshallhenceforthbeconstruedasreferencestothisDirective.

Article9

MemberStatesshallbringintoforcethelaws,regulationsandadmin-istrativeprovisionsnecessarytocomplywiththisDirectivenotlaterthan25September1996inorderto:

—allow,by25September1996atthelatest,tradeinanduseofproductsconformingtothisDirective,

—prohibitby25March1997atthelatest,tradeinanduseofproductsnotconformingtothisDirective;productsputonthemarketor

TheCommitteeshalladoptitsrulesofprocedure.

WhenMemberStatesadoptthesemeasures,theyshallcontainarefer-encetothisDirectiveorshallbeaccompaniedbysuchreferenceontheoccasionoftheirofficialpublication.ThemethodsofmakingsuchreferenceshallbelaiddownbytheMemberStates.

ThisDirectiveshallenterintoforceontheseventhdayfollowingthatofitspublicationintheOfficialJournaloftheEuropeanCommunities.

ThisDirectiveisaddressedtotheMemberStates.
