医疗诉讼中的专家证人和鉴定人出庭有何作用

对于专业性问题，往往办案人员、被告、原告、辩护人、诉讼代理人也并不明白，对于鉴定结论就难免存在信赖心理。如果由专家在庭审时对专业性问题提出自己的专业意见，在询问案情及鉴定人的基础上，能够回答参加庭审各方的疑问，则更有利于事实真相的发掘，有利于解决双方对于案件事实部分的矛盾。但专家证人只能对鉴定人做出的鉴定结论发表评论性意见，而不能提出新的鉴定结论。

鉴定人出庭的主要任务就是回答当事人的质询和法官的提问，帮助法庭分析清楚一些具体问题，从而给法庭是否采纳其鉴定结论提供进一步的依据。尤其是在存在不同鉴定结论的情况下，采纳哪一家的鉴定意见，不通过鉴定人出庭，往往难以抉择。这样就彻底改变了以往司法鉴定被普遍质疑为“暗箱操作”的现象，一方面可促使鉴定机构和鉴定人为法官办案提供的结论承担其责任，使法官看到的不仅仅是鉴定结论，还包括形成这些结论的切实依据、必要过程等。从而理顺了司法审判和科学鉴定的关系，保障了司法权威；另一方面可从国家法律的层面上赋予案件当事人重要的诉讼权利。

出庭制度的由来

根据2002年4月1日实施的《关于民事诉讼证据的若干规定》第61条首次将国外的专家证人制度引入中国，第59条第1款明确规定“鉴定人应当出庭接受当事人质询”，这两项制度实施已经5年以上。

2017年10月1日实施的《全国人大常委会关于司法鉴定管理问题的决定》第13条第2款更进一步规定了鉴定人或者鉴定机构拒绝出庭作证的法律责任。鉴定人出庭至此有了完整的法律制度规范。

怎样申请鉴定人出庭

不是所有鉴定结论的鉴定人都可以出庭。根据《全国人大常委会关于司法鉴定管理问题的决定》第11条规定，鉴定人出庭应当由对鉴定意见有异议的当事人在开庭前一定时间内向人民法院申请，由人民法院通知。

申请出庭应在何时提出

根据《关于民事诉讼证据的若干规定》第54条第1款规定：“当事人申请证人出庭作证，应当在举证期限届满十日前提出，并经人民

法院许可。”该条规定的举证期限届满十日之前，考虑的是要为法院通知证人留有时间。

一般理解，专家证人和鉴定人都属于证人的范围。这两类人员出庭的申请期限应当符合上述规定。有的法院在举证通知中还会明确告知申请证人出庭的具体截止日期。

出庭费用由谁承担

根据《关于民事诉讼证据的若干规定》第54、61条规定，鉴定人出庭费用由败诉方当事人承担；而专家证人的出庭费用则由申请其出庭的当事人承担。

如何发问和质询

一般要通过专业律师的全面策划。申请专家证人出庭的一方当事人一般针对需要专家证人出庭说明的问题简明扼要地提出，让专家向法庭说明。对方当事人一般要结合己方对专门知识的理解，抓住证人可能混淆的问题提问。

根据《关于民事诉讼证据的若干规定》第61条第2~4款分别规定：“审判人员和当事人可以对出庭的具有专门知识的人员进行询

问”、“经人民法院准许，可以由当事人各自申请的具有专门知识的人员就案件中的问题进行对质”、“具有专门知识的人员可以对鉴定人进行询问”。

对专家证人和鉴定人询问要经人民法院准许。对方当事人申请的专家证人的询问可以通过己方申请的专家证人与其“对质”的方式进行；可以由己方申请的专家证人直接对鉴定人进行询问。

出庭制度的启示

专家证人和鉴定人出庭给人民法院审理诸如医疗纠纷这样专业性较强的案件提供了便于操作的程序和手段。但是，这些程序和手段一般要基于当事人的依法申请才能启动和采用。所以，要否申请、如何申请、何时申请，以及如何把握申请这类人员出庭的机会等等，既是当事人的法定诉讼权利，也是当事人根据具体案情能够采取的重要诉讼策略。
