非常高兴与大家相聚在美

丽的深圳。首先我代表中国商务部向论坛的召开表示祝贺！我愿借此机会就"知识产权与自主创新"问题与大家进行交流。

改革开放以来，中国经济飞

速发展，对外贸易成绩显著。2004年中国进出口总额超过1.1万亿美元，贸易额跃居世界第三位，对外贸易迈上了一个新台阶。从发展速度看，从1978年到2004年，世界贸易约增长了6.4倍，年均增长约6.6%；而我们增长了56倍，年均增长16.8%。特别是加入世贸组织3年来，我国进出口规模翻了一番。

在数量增长的同时，我国对

Ladies and Gentlemen,

I am very pleased to gather together with you in the beautiful city of Shenzhen. First of all, I would like to, on behalf of the Ministry of Commerce of China, extend congratulations on the convening of this forum. I would like to take this opportunity to exchange views with you on the topic of "intellectual property and independent innovation".

Since reform and opening up, China's economy has been developing rapidly with tremendous achievements in foreign trade. In 2004, the total import and export volume of China exceeded US$ 1.1 trillion. The country's trade volume jumped to the third in the world, bringing its foreign trade up to a new level. Speaking of the rate of development, the world trade has increased by 6.4 times from 1978 to 2004 with an average annual growth rate of 6.6%; while China's trade has increased by 56 folds with an average annual growth rate of 16.8%. Since China's WTO accession three years ago, its import and export scale has doubled.

While achieving quantitative growth, we have also improved substantively the

女士们，先生们：

中国经济和对外贸易发展的良好局面来之不易，这与我国政府尊重和重视知识产权是分不开的。随着科学技术的发展、知识经济的兴起和经济全球化进程的加快，知识产权的重要性得到了历史性提升。经过二十多年的努力，中国知识产权事业全面发展，为鼓励自主创新，增强自主研发能力，提高国际竞争力提供了坚实基础和有力保障。

quality of foreign trade. Since the implementation of the strategy of

rejuvenating trade through science and technology in 1999, the trade in high-tech products has been developing rapidly, with the import and export volume registering an average annual growth rate of 37%. The share of export of high-tech products in the total foreign trade has climbed to 28%, more than doubling that of 1998. This year, the total import and export of high-tech products is expected to reach US$ 400 billion. A number of well-known brands and enterprises with proprietary intellectual property such as Huawei, Haier and Changhong have emerged quickly, and the export scale and scope of high-tech products is widening with every year. The constant development of China's foreign trade in high-tech area has not only promoted development in the high-tech sector, accelerated industrial

restructuring and technological progress, but also opened an enormous new market to the rest of the world.

Ladies and Gentlemen,

The upbeat situation of China's economy and foreign trade is hard won, and is

inseparable from the respect and attention paid by the Chinese government to IPR protection. With the development of science and technology, the rise of knowledge-based economy, and the acceleration of economic globalization, the importance of

intellectual property has been enhanced historically. Through efforts over the last two decades, intellectual property has gained overall development in China, laid a solid foundation and constituted a strong guarantee for encouraging independent innovation, strengthening independent research and development capacity, and boosting international competitiveness.

第一，逐步完善的知识产权

法律法规体系促进了技术进步与创新。新《专利法》及其配套法规颁布实施以来，我国专利申请与审批量持续大幅增长，专利申请结构发生积极变化，技术创新活动日趋活跃。2004年，我国共受理专利申请34.9万件，比2001年增长

66.5%。授权19.2万件，同比增长63.5%。1995年以来，国内专利申请中发明专利的申请量大幅增长，发明专利申请量年均增长33％。作为技术创新主体的企业，近年来的发明专利申请量已占同期国内职务发明专利申请量的60％以上。

第二，积极的知识产权执法

保护为技术引进和创新营造了良好的环境。中国政府高度重视知识产权执法保护，专门成立了以吴仪副总理为组长的全国保护知识产权工作组，并开展了知识产权专项行动。中国政府认真组织了一系列的专项执法行动。截至2004年底，全国各地专利管理部门共受理专利侵权、专利纠纷案件12058件，结案10411件，结案率达86.3％。严格的知识产权执法保护，改善了我国的投资和对外贸易环境，促进了外国企业对华转让技术和在华设立研发中心，为企业自主创新奠

First, the notably improved legal

framework on IPR promotes technological advancement and innovation. Since the promulgation of the new Patent Law and supporting laws and regulations, there has been a sustained increase in patent applications and approvals. Positive changes have taken place in patent

application structure, and technological innovation activities become increasingly dynamic. In 2004, we accepted 349,000 patent applications, an increase of 66.5% compared with 2001. Among that we granted 192,000 patents, increasing by 63.5% on a year-on-year basis. Since 1995, the number of invention patents among domestic patent applications has shown a big rise, with an average annual growth rate of 33%. In recent years, the number of invention patent applications from enterprises, the main player of technological innovation, has accounted for more than 60% of the total domestic service invention applications in the same period of time.

Second, the active IPR law enforcement and protection has created a favorable environment for technological

introduction and innovation. Attaching great importance to IPR law enforcement and protection, the Chinese government

established a national working group on IPR protection headed by Vice Premier Wu Yi and launched a special campaign of IPR protection. The Chinese government

carefully organized a series of special law enforcement actions. By the end of 2004, patent authorities throughout the country had dealt with 12,058 cases of patent violation and patent disputes, among which 10,411 cases or 86.3% were closed. The strict IPR law enforcement and protection ameliorates China's investment and foreign trade environment, facilitates foreign

制度的良好结合为我企业在国际竞争中取胜提供了政策保证。新《对外贸易法》中"对外贸易有关的知识产权保护"一章对进口产品侵犯知识产权、知识产权滥用和我国企业在国外受到知识产权保护状况的监控进行了规定，特别是确立了通过贸易措施保证其他国家或地区对我的货物、技术和服务提供充分有效的知识产权保护制度。国家知识产权局加入科技兴贸联合工作机制后，与商务部共同推动实施

"知识产权兴贸工程"。这表明中国政府已经认识到知识产权在对外贸易中的重要作用。在政府的政策引导下，我部分企业立足于自主知识产权的创造、实施和保护，凭借自主创新，在国际市场占据了一席之地。河南新乡瑞丰化工有限公司研制的醚化剂等产品，通过获得国家发明专利，绕过跨国公司的技术壁垒，成功进入国际市场。中星微电子公司开发设计的"星光中国芯"五代数字多媒体芯片实现了七大核心技术突破，申请了200多项国内外专利。该芯片第一个大规模打入国际市场，被三星、飞利浦、联想等国内外企业采用，产品在全球市场的销售量已

enterprises in transferring technology to and establishing R&D centers in China, and lays a solid foundation for independent corporate innovation.

Third, the fine combination of foreign trade and intellectual property regime has provided policy assurances for enterprises to excel in international competition. The chapter of "IPR Protection in Relation to Foreign Trade" in the new

"Foreign Trade Law" targets the violation of IPR by imported products, abuse of IPR and the monitoring of Chinese enterprises in terms of their IPR protection in foreign countries. In

particular, it establishes a regime that guarantees adequate and effective IPR protection on Chinese goods, technologies and services by other countries and regions through trade instruments. After joining the joint taskforce on rejuvenating trade through science and technology, SIPO has been promoting the project of "rejuvenating trade through

intellectual property" together with MOFCOM, which indicates that the Chinese government has realized the importance of intellectual property in foreign trade. Guided by government policy, some

enterprises have found a foothold in the international market based on the creation, implementation and protection of

proprietary intellectual property, and independent innovation. CTA and other products developed and produced by Ruifeng Chemical Co. Ltd. in Xinxiang, Henan

Province circumvented technical barriers of multinational corporations by obtaining national invention patents, and

successfully entered the international market. The Vimicro VXP V chip developed and designed by Vimicro made 7 core

technological breakthroughs and applied

当今世界,知识产权制度的变革与发展已进入一个空前活跃的阶段，知识产权在世界经济、科技和贸易中的重要地位日益显现，并成为促进一个国家经济发展的至关重要因素。强化知识产权制度，已成为世界各国发展科技、经济和增强国力的必然选择。日本明确提出从科技立国到"知识产权立国"的基本国策；美国将知识产权当作国家基础性的战略资源，把强化知识产权保护作为重要的竞争手段，把深化知识产权管理特别是对专利的管理作为指导科技创新、经济结构调整以及产业技术结构优化升级的重要手段。从国际大环境来看，知识产权保护范围正在不断扩大，知识产权保护水平正在进一步提高，围绕知识产权的竞争日益加剧。知识产权已成为连接技术、经济和贸易的纽带。

for over 200 patents in China and other countries. The chip took the lead in setting foot in the international market at a large scale, and has been adopted by domestic and foreign enterprises including Samsung, Philips and Lenovo. The global sales volume of this product has exceeded 10 million pieces, taking up 40% share in the international market.

Ladies and Gentlemen,

In today's world, the reform and

development of IPR system has entered an unprecedentedly dynamic stage.

Intellectual property has played an increasingly prominent role in world

economy, science and technology and trade, as well as a vital factor behind a nation's economic growth. To strengthen IPR

protection has become a natural choice for countries to develop science and technology and their economies, and to enhance national strength. Japan has explicitly put forward the basic state policy of "building the country through

intellectual property" replacing the previous one of "building the country through science and technology". The U.S. takes intellectual property as a fundamental national strategic resource. It identifies IPR protection as an important tool for competition, and deepening IPR management, especially patent management, as a significant instrument to guide technological

innovation, economic restructuring and optimization and upgrading of industrial technological structure. In this global context, the coverage of IPR protection is widening, the level of protection is

becoming higher, and competition centering on IPR is getting fiercer and fiercer. Intellectual property has become a bridge

未来15年，是中国走新型

工业化道路，实现全面建设小康社会奋斗目标的关键时期，也是我国实现贸易大国向贸易强国跨越的关键时期。要实现外贸增长方式的根本转变，提高对外贸易的质量和效益，就必须重视自主知识产权和自主品牌的带动作用，通过加强知识产权制度建设，提高企业自主创新能力和核心竞争力。商务部十分重视知识产权制度对自主创新的带动作用。薄熙来部长最近指出："没有完善的知识产权保护体系，中国的自主创新的能力就不可能得到释放，这不仅关系中国的形象，更影响我们自身的发展，事关中国的利益。"商务部将与国家知识产权局一起，在以下五个方面积极开展工作。

一是继续完善知识产权法

规体系。我们要依据新《外贸法》，制定和出台有关对外贸易中知识产权管理的配套法规，继续强化知识产权制度在对外贸易中的地位，切实保证企业的知识产权不受侵犯，激发企业的自主创新热情，让企业靠知识产权发展和保护自己。

二是制定出台"知识

产权兴贸"的政策措

The coming 15 years is a crucial period for China to take the course of new industrialization and realize the

objective of building a well-off society in an all-round way, and also a crucial period for China to transform itself from a big trading country to a strong trading power. The fundamental transformation of the developmental mode of foreign trade and improvement of the quality and effect of foreign trade demands attention to the driving role of proprietary IPR and brands. Through a strengthened IPR system, the innovation capability and core

competitiveness of enterprises will be enhanced. MOFCOM attaches great importance to the driving role played by IPR in

independent innovation. Minister Bo Xilai recently pointed out, "Without a sound IPR protection system, it will be impossible for China to release its independent innovation capability. That has a bearing not only on China's image but also on our development and our

interests." MOFCOM and SIPO will engage themselves together in the following five aspects:

First, we will continue to improve the legal framework concerning IPR. We will formulate and promulgate supporting laws and regulations governing foreign trade related IPR administration based on the new Foreign Trade Law, further consolidate the status of IPR system in foreign trade, concretely prevent IPR violation, inspire the enthusiasm of enterprises for

independent innovation and enable them to develop and protect themselves through IPR. Second, we will formulate and materialize the policy measure of "rejuvenating

施。我们将会同国家知识产权局制定《"十一五"实施知识产权兴贸工程的意见》，通过改善政策环境，促进知识产权与科技、经济、贸易的协调发展，鼓励和引导企业运用知识产权，保护自主创新成果，增强技术成果产业化能力，从而达到提高企业核心竞争力和产品国际市场份额的目的。

三、积极参与国家知识产权战略制定工作。国家知识产权战略的目标之一，就是要大幅度提高企业的创新能力和运用知识产权制度参与国际市场竞争能力，形成一批核心竞争力强，拥有自主知识产权的技术和大企业集团。我们要抓住国家知识产权战略制定的机遇，加强对影响外贸发展的深层次知识产权问题的研究，实现科技兴贸战略与国家知识产权战略的有机融合，以知识产权促进科技兴贸的进一步发展。

四、加强知识产权执法保护力度。把保护知识产权纳入商务工作的总体安排，联合有关部门采取切实措施改善执法手段，调整充实执法力量，进一步强化执法，加强执法协调，严厉打击侵犯知识产权行为；以重大案件

Implementing the Project of Rejuvenating Trade through Intellectual Property during the Eleventh Five-year Period". With an improved policy environment, we will promote the coordinated development among IPR, science and technology, economy and trade, encourage and guide enterprises to use IPR so as to reach the goal of enhancing the core competitiveness of enterprises and market share in the global context.

Third, we will actively participate in the formulation of the national intellectual property strategy. One of the objectives of national intellectual property strategy is to uplift substantially enterprises' innovation ability and the ability to participate in international competition by using IPR, and to form a number of technologies and big corporate groups with strong core competitiveness and proprietary IPR. We must seize the opportunity of formulating national

strategy on IPR, strengthen study on IPR issues at such a deep level that it can shape foreign trade development, realize the organic integration between the strategy of rejuvenating trade through science and technology and the national strategy on IPR, and promote further development of the former strategy through intellectual property.

Fourth, we will intensify law enforcement and protection of intellectual property. IPR protection will be incorporated into the overall arrangement of commercial work. We will work together with relevant

departments to take concrete measures to improve law enforcement methods, adjust and consolidate law enforcement team,

的督办为突破口，进一步深化保护知识产权专项行动；继续加强宣传教育工作，通过"保护知识产权宣传周"和"保护知识产权成果展"，创造良好的保护知识产权社会氛围，为企业自主创新提供有力保障。

五、积极开展知识产权的国际交流与合作。继续参与世界贸易组织、世界知识产权组织、亚太经济合作组织等国际组织在知识产权领域的各项活动，并加强与其双向交流与合作。在"中欧知识产权对话机制"、"中美知识产权工作组"、"中日韩知识产权双边及三边对话与合作机制"的基础上，与香港、澳门以及巴西、墨西哥、东盟等国家和地区开展多种形式的保护知识产权交流与合作，以增进相互沟通和理解，为企业自主创新营造良好的国际市场环境。

女士们，先生们：

本世纪前20年，是中国走

新型工业化道路，全面建设小康社会，加速现代化建设进程的战略机遇期。我们要

reinforce law enforcement, enhance coordination of law enforcement and severely crack down on IPR violating

activities. We will take the monitoring and tackling of major cases as breakthroughs to intensify the special campaign of IPR protection. We will continue the efforts in publicity and education, and foster a favorable social atmosphere for IPR protection through the "IPR

Protection Week" and "Display of IPR Protection Achievements" so as to provide a strong guarantee for independent innovation of enterprises.

Fifth, we will actively engage in international communication and

cooperation concerning IPR. We will

continue our participation in IP-related activities in various international

organizations such as the WTO, the WIPO and APEC, and strengthen two-way communication and cooperation. On the basis of "Sino-EU Dialogue Mechanism on

IPR", "Sino-US Working Group on IPR", and "bilateral and trilateral dialogue and cooperation mechanism on IPR among China, Japan and Korea", we will launch communication and cooperation on IPR protection in various forms with countries and regions including Hong Kong, Macao, Brazil, Mexico, and ASEAN members. In that way, mutual communication and understanding will be enhanced, and a sound international market environment will be created for independent innovation of enterprises. Ladies and Gentlemen,

and expedite the modernization drive. We should grip the opportunities, utilize and protect IPR, foster and promote capacity building among enterprises for independent innovation, and accelerate the creation and cultivation of proprietary IPR and own brands in China's high-tech sector. We will show the whole world that China not only boasts textile and light industry products with low price and good quality, but also high-tech products and brands with

proprietary IPR that represent the talent and wisdom of the Chinese nation. We are ready to provide even more, better and more professional services to enterprises.
