If this Chinese Company wants to offer FOB Guangzhou price to its customer now, please calculate how much this company should offer

A Chinese exporter exported 500 M/T walnut to a Canadian importer on the basis of USD4800 per M/T CIF Quebec. Both parties agreed to stipulate the following in the contract:

“…… Payment by acceptance L/C and draft at 30 days after sight.

L/C should be issued by the end of September, 2008 and keep valid till Nov. 20th, 2008.

Shipment from Guangzhou port, not later than Oct. 31st, 2008.

Partial shipment and transshipment are prohibited. ……”

After received the relevant qualified L/C, the exporter shipped the goods in Guangzhou port on Oct. 10th, 2008 and got clean on board B/L.

The usual time for transporting goods from China to Canadian by sea will not exceed 30 days. However, due to bad weather, the liner arrived at Quebec on Dec. 5th, 2008 and 20% of goods have been damaged during transportation.

The importer informed the issuing bank of L/C and the exporter of giving up payment and refusing to take the delivery of the goods unless 20% discount of the total value of the goods was made for the loss incurred to the importer.

1. If the exporter has made complying presentation on time to issuing bank,

insurance company should compensate the damage? Why?

5. If the exporter has insured for W.P.A. on Oct 8th, 2008, do you think the

insurance company should compensate the damage? Why?

6. If the insurer should compensate the damage, who ( the exporter or the
