清远市城市规划技术管理规定

第一部分

总则

1.总则

1.1

为科学编制城市规划,严格城市规划管理,实现城市规划管理的标准化、规范化和法制化,保证城市规划方案的实施,根据《中华人民共和国城乡规划法》、《广东省城乡规划条例》以及其它相关法律和法规的规定,制定本规定。

1.2

在清远市城市规划区范围内从事城乡规划编制和规划管理工作,应按本规定执行。本市规划区内的临时建设、村镇建设和私有房屋建设按其他有关规定执行。

1.3

清远市城乡规划的编制和管理除执行本标准与准则外,还应符合国家、省和市现行有关法律、法规及其它强制性标准的规定。

1.41.5

本标准与准则解释权属清远市城乡规划局。本标准与准则自发布之日起60日后施行。

2.城市用地分类与规划建设用地标准

2.1

用地分类

2.1.1用地分类适用于各阶段城乡规划的编制、用地统计和用地管理工作。用地分类包括城乡用地分类、城市建设用地分类两部分,应按土地使用的主要性质进行划分。

2.1.2根据《城市用地分类与规划建设用地标准》(GB50137-2011),城乡用地分为2大类、9中类、14小类,城市建设用地分为8大类、35中类、43小类。

2.1.3用地分类和代码应符合表2.1.1、表2.1.2的规定。

用地兼容

2.2.12.2.2

控制性详细规划必须制定土地使用兼容性的规定。

各类建设项目必须满足经批准的控制性详细规划的土地使用兼容性的规定。

2.2.3编制控制性详细规划土地使用兼容性的规定宜符合表2.2《土地使用兼容性表》的要求。

2.2.4凡需改变规划用地性质或超出经批准的控制性详细规划土地使用兼容性规定范围的建设项目,应先由城市规划行政主管部门提出调整意见,经清远市城市规划委员会同意,再报市人民政府批准。

3.居住用地

3.1布局准则

3.1.1居住用地应相对集中布局,形成相应规模的居住区、居住小区或基层社区,规模标准应符合表3.1.1的规定。

3.1.2居住用地的建筑布置,应综合考虑日照、采光、通风、防灾以及管理要求,避免烟、气(味)、尘和噪声等造成的污染和干扰;居住建筑的间距应符合本管理规定第三部分的规定。

3.2规划标准

3.2.13.2.2

居住用地的配套设施标准按照本管理规定第4章的规定执行。居住用地规划主要技术指标统计内容应不少于表3.2.2要求。
