POLICY

方针

FOR THE PURPOSE OF ENSURING THE EFFECTIVE IMPLEMENTATION AND ENFORCEMENT OF MLC 2006 AND SECURING THE RIGHT OF ALL SEAFARER TO DECENT EMPLOYMENT, MAPLE LEAF SHIPPING CO., LTD. CREAT THIS MANUAL ENBODYING STANDARDS OF INTERNATIONAL MARITIME LABOUR CONVENTIONS, NATIONAL LAWS, REGULATIONS AND RELATIVE AGREEMENTS TO ENSURE ONGOING COMPLIANCE BETWEEN INSPECTIONS.

为有效地实行和执行2006年海事劳工公约(以下简称“公约”),确保海员体面的就业,台州市椒江枫叶海

运有限公司制定本手册,本手册参照国际海事劳工公约,国家法律,条例及相关的协议的要求,以确保检

查之间持续符合公约的要求

享受健康保护、医疗、福利措施及其他形式的社会保护。

FULLY AUTHORIZED THE DESIGNATED PERSON TO EFFECTIVELY EXERCISE CONTROL ON THE SEAFARER AND MANAGED VESSEL, INCLUDING REGULAR INSPECTION, REPORTING, MONITORING AND PROCEEDING THROUGH THE PROCEDURE HAS BEEN DRAW UP, PROHIBITING AND CORRECTING THE VIOLATIONS OF THE REQUIREMENTS OF MLC 2006,IN ORDER TO PROPERLY COMPLING WITH AND ENFORCING THE RIGHT AND PRINCIPLES,

授权指定人员对管理的海员和船舶有效地进行管理,包括按照本程序进行的定期检查,报告,监督和处理.

对违反公约的行为予以制止和纠正,以确保这些权利和原则妥善的遵守和执行。

General

总则

1.Definitions定义

For the purpose of this Manual and unless provided otherwise in particular provisions, the term:

除非具体条款另行规定,就本手册而言:

a)competent authority means the minister, government department or other authority having

power to issue and enforce regulations, orders or other instructions having the force of law

in respect of the subject matter of the provision concerned;

“主管当局”一词系指有权就公约规定的事项颁布和实施具有法律效力的条例、命令或其他指

令的部长、政府部门或其他当局;

b)declaration of maritime labour compliance means the declaration referred to in Regulation

5.1.3;

“海事劳工符合声明”一词系指规则5.1.3所述之声明;

c)gross tonnage means the gross tonnage calculated in accordance with the tonnage

measurement regulations contained in Annex 1 to the International Convention on Tonnage

Measurement of Ships, 1969, or any successor Convention; for ships covered by the

tonnage measurement interim scheme adopted by the International Maritime Organization,

the gross tonnage is that which is included in the REMARKS column of the International Tonnage Certificate (1969);

“总吨位”一词系指根据《1969年船舶吨位丈量国际公约》附则一或任何后续公约中的吨位丈量规定所计算出的总吨位;对于国际海事组织通过的临时吨位丈量表所包括的船舶,总吨位为填写在《国际吨位证书(1969)》的“备注”栏中的总吨位;

d)maritime labour certificate means the certificate referred to in Regulation 5.1.3;

“海事劳工证书”一词系指规则5.1.3中所述之证书;

e)requirements of this Convention refers to the requirements in these Articles and in the

Regulations and Part A of the Code of this Convention;

“本公约的要求”一词系指本公约的正文条款和规则及守则A部分中的要求;

f)seafarer means any person who is employed or engaged or works in any capacity on board

a ship to which this Convention applies;

“海员”一词系指在本公约所适用的船舶上以任何职务受雇或从业或工作的任何人员;

g)seafarers’ employment agreement includes both a contract of employment and articles of

agreement;

“海员就业协议”一词包括就业合同和协议条款;

h)seafarer recruitment and placement service means any person, company, institution,

agency or other organization, in the public or the private sector, which is engaged in recruiting seafarers on behalf of shipowners or placing seafarers with shipowners;

“海员招募和安置服务机构”一词系指公共或私营部门中从事代表船东招募海员或与船东安排海员上船的任何个人、公司、团体、部门或其他机构;

i)ship means a ship other than one which navigates exclusively in inland waters or waters

within, or closely adjacent to, sheltered waters or areas where port regulations apply;

“船舶”一词系指除专门在内河或在遮蔽水域之内或其紧邻水域或适用港口规定的区域航行的船舶以外的船舶;

j)shipowner means the owner of the ship or another organization or person, such as the manager, agent or bareboat charterer, who has assumed the responsibility for the operation of the ship from the owner and who, on assuming such responsibility, has agreed to take over the duties and responsibilities imposed on shipowners in accordance with this Convention, regardless of whether any other organization or persons fulfil certain of the

duties or responsibilities on behalf of the shipowner.

“船东”一词系指船舶所有人或从船舶所有人那里承担了船舶经营责任并在承担这种责任时已

同意接受船东根据本公约所承担的职责和责任的另一组织或个人,如管理人、代理或光船承租

人,无论是否有任何其它组织或个人代表船东履行了某些职责或责任。

a)ILO — International Labor Organization;

ILO —国际劳工组织;

Minimum age(Regulation 1.1)

最低年龄(规则1.1)

1.The employment, engagement or work on board of any person under the age of 18 shall be

prohibited.

禁止任何18岁以下的人员受雇、受聘或到船上工作

2.Verification

证件核实

a)Prior to employment, engagement or work on board, seafarer should present his or her

identification document to Marine Personnel Department,issued by Competent Authority,

confirming his or her age,the following document include but not limit to:

受雇,受聘或到船工作前,海员应向船员部出示由主管当局签发的证明文件,以证实自己的年

龄。这些文件包括但不限于:

i.Seaman’s Passport 海员证

ii.Seafarer’s Identity Document 海员服务簿

b)Marine Personnel Department check the certificate to determine whether the basic

information, such as Date of birth, Name, etc. are consistent with other document produced

by seafarer, where certificate forged or altered, the seafarer should not be employed.

船员部对上船海员持有的证书进行核对,核对其与其他证书的基本信息是否一致,这些信息包

括海员出生日期,姓名等。如有伪造,涂改的情况,不予录用。

c)Master should check seafarer sign-on against valid identification documents to ascertain if

the holder of certificate is him/her。When the documents not being in conformity with the

holder physical attributes,or forged document,master should inform shipowner as soon

as possible so as to take appropriate measures by shipowner

船长对到船工作海员的证件进行核对,确认证件持有者是否本人,如果发现与本人体貌特征情

况不符或伪造证件时,立即报告船东以便船东采取相应的措施

3.Document Keeping

文件记录

a)Marine Personnel Department keep the Scanning soft-copy of above-mentioned Certificate

of Seafarer。

船员部保留海员上述证件电子版扫描件。

b)Marine Personnel Department keeps the sign on/sign off record when seafarer changes.

安排海员上船下船时,船员部保留受雇,受聘或到船工作海员的上下船动态记录

c)Master update the crew list immediate after crew change,date of birth of each seafarer is

noted against his/her name on the crew list.

海员更换后,船长立即对船员名单进行更新,每一海员的出生日期应在船员名单中的姓名旁标注.

d)Master or officer acting on his or her behalf (“competent officer”) verify the crew list at proper

interval and record the date of such verification.

船长或代表船长的高级海员(“主管高级海员”)定期核查船员名单,并记录核查的日期

e)Master should keep employment records of seafarer, include the sign-off seafarer,船长应保

持海员受雇在船的记录,包括已经下船海员的受雇记录

Medical Certificate(Regulation 1.2)

体检证书(规则1.2)

1.Prior to employment on board Seafarers should be in possession of a valid medical certificate and

Vaccination/ Prophylaxis Certificate attesting that they are medically fit to perform the duties they are to carry out at sea.

海员上船工作前应持有有效的体检证书和预防接种证书,证明其健康状况适合其将在海上履行的职责。

2.Verification

证书核查

a)Marine Personnel Department should focus on the following:

船员部应重点关注:

i.Marine Personnel Department check the medical certificate and Vaccination/

Prophylaxis Certificate to determine whether the basic information, such as Date of birth,

Name, etc. are consistent with other document produced by seafarer, where certificate

forged, altered, the seafarer should not be employed.

船员部对上船海员持有的体检证书和预防接种证书进行核对,核对其与其他证书的基本信

息是否一致,这些信息包括海员出生日期,姓名等。如有伪造,涂改的情况,不予录用。

ii.General comment on the medical certificate generated by medical practitioner to determine whether a potential employee is fit for duty.

体检证书上体检医生给出的结论,确定未来雇员的健康状况是否足以胜任其工作

iii.Validity data

证书的有效期

iv. A English version must be provided / attached

必须提供英文版本。

v.The medical certificate shall comply with the Requirements issued by the Competency Authority specifying the standards of medical fitness for seafarer in accordance with the

STCW Convention 1978, as amended from time to time.

体检证书要符合主管当局根据修订的1978 年STCW 公约制定的对海员健康标准的规定

vi.The medical certificate shall be issued by a duly qualified medical practitioner or, in the case of a certificate solely concerning eyesight, by a person recognized by the

competent authority as qualified to issue such a certificate.

体检证书应由有正规资格的医师签发,或者,对于只涉及视力的证书而言,由经主管当局

认可的具备签发证书资格的人员签发。

b)Master should check seafarer sign-on against medical certificate and Vaccination/

Prophylaxis Certificate to ascertain if the holder of certificate is fit for his/her duty。When the

documents forged or altered, master should inform shipowner as soon as possible so as to

take appropriate measures by shipowner.

船长对到船工作海员的体检证书和预防接种证书进行核对,确认证件持有者适任,如果发现证

书涂改或者伪造时,立即报告船东以便船东采取相应的措施

3.Document Care

证书保管

a)If the medical certificate is verified to be true,valid and fit for duty on board, Marine

Personnel Department scan the Medical Certificate and Vaccination/Prophylaxis Certificate

and keep the soft-copy

船员部检查体检证书真实有效能够适任船上工作后,对体检证书和预防接种证书进行扫描,并

保留电子版的扫描件

b)Marine Personnel Department registers and files the Medical Certificate and Vaccination

/Prophylaxis Certificate in List of crew certificate.

船员部对体检证书和接种证书的有效期在船员证书清单中登记归档.

c)When the medical certificate or Vaccination / Prophylaxis Certificate of the seafarer

employed on board become due,master should inform the shipowner to make necessary

arrangement in advance.

海员在船服务期间,如果体检证书或预防接种证书到期,船长应提前通知船东进行必要的安排

d)Master should update the List of Document immediate after crew change/certificate

replacement and reserve the records

船员更换/证书换新后,船长立即对证书清单进行更新, 船长应保留该证书清单

e)If the period of validity of a certificate expires in the course of a voyage, the certificate shall

continue in force until the next port of call where the seafarer can obtain a medical certificate

from a qualified medical practitioner, provided that the period shall not exceed three months.

如果在航行途中证书到期,该证书应继续有效至该海员能够从合格医师那里取得体检证书的下

一停靠港,条件是这段时间不超过3个月。

4.Each medical fitness certificate shall state in particular that the scopes of health conditions of the

seafarer as stipulated in Standard A1.2.6 of the Convention.

每份体检证书应当特别说明公约标准A1.2.6 规定的海员健康状况范围。

5. A medical fitness certificate issued shall specify the period, commencing with the date of the

medical examination, for which the certificate shall remain valid, subject to the following maximum periods :

体检证书应明确证书的有效期,从进行体检之日起,至下述最长期限为止:

a)in respect of a seafarer 18 years of age and under 55 years of age, 2 years;

18 周岁以上55 周岁以下的海员,2 年;

b)Colour vision test is valid for no more than 6 years.

色觉视力测试的有效期最多为6 年。

6.In urgent cases, a seafarer may be permit to work without a valid medical certificate until the next

port of call where the seafarer can obtain a medical certificate from a qualified medical practitioner, provided that:

在紧急情况下,可以允许没有有效体检证书的海员工作直至该海员可以从合格的医师那里取得一份体检证书的下一停靠港。条件是:

a)Obtain the approval of competent authority,

获得主管当局的批准

b)the period of such permission does not exceed three months; and

所允许的期间不超过3个月;并且
