疫情影响下劳动纠纷的法律问题与对策研究

摘 要

20xx年新冠肺炎的爆发使得我国的劳动纠纷大量出现,和谐的劳动关系因此受到影响。在疫情期间,企业与劳动者所产生的劳动纠纷一是因用人单位开除、辞退、自动离职等而产生的劳动纠纷;二是因用人单位执行国家的福利待遇而产生的纠纷;三是因劳动合同而产生的劳动纠纷。且疫情作为特发公共卫生事件和不可抗力因素同样也影响了企业和劳动者之间合同的正常履行。最后,为减少我国在疫情期间劳动纠纷的出现、稳定社会秩序提出了自己的对策。

ABSTRACT

The outbreak of the new crown pneumonia in 2020 has caused a large number of labor disputes in our country, and harmonious labor relations have been affected. During the epidemic, labor disputes between enterprises and workers are: First, labor disputes arising from dismissal, dismissal, voluntary resignation, etc.; labor disputes arising from contracts. In addition, the epidemic, as an idiosyncratic public health event and a force majeure factor, also affects the normal performance of contracts between enterprises and workers. Finally, we put forward our own countermeasures to reduce the occurrence of labor disputes and stabilize the social order in my country during the epidemic.
